INTRODUCTION

The purpose of this notice is to provide you with information on our use of your personal data in accordance with the Data Protection Law, 2017 (the “DPL”).

In this document, “we”, “us” and “our” refers to TSC Financial Services Limited, affiliates, and/or delegates.

The TSC Financial Services Limited Privacy Policy will tell you our obligations to you, and when we collect your personal information, this includes how we will process and use your information as well as how we will ensure that your information is kept secure and your privacy is maintained.  This Policy will explain, how long we retain your personal information as well as your rights and responsibilities to ensure you inform us of changes to your personal information.

We act as an intermediary for several international investment companies, investment platforms, fund managers with whom we have entered into agency and referral agreements each, a “Product Provider”.

By using and/or registering on our website or making an investment through us and your associated interactions with us, (whether past, present, or future), you will provide us with certain personal information which constitutes personal data within the meaning of the DPL. In our use of your personal information, we will be characterised as a “data controller” for the DPL. Our affiliates and delegates may act as “data processors” for the DPL.

We require your consent to process, store and share your Personal data. 

By your interaction with us on our website, electronically, verbally or in writing, you are giving us your consent.

WHO THIS AFFECTS

If you are a natural person, this will affect you directly. If you are a corporate investor (including, for these purposes, legal arrangements such as trusts or exempted limited partnerships) that provides us with personal information on individuals connected to you for any reason concerning your investment through us, this will be relevant for those individuals and you should transmit this document to such individuals.

IN MOST CASES, WE DO NOT COLLECT ANY “SENSITIVE” PERSONAL INFORMATION ABOUT YOU. SENSITIVE PERSONAL DATA INCLUDES:

However, while we do not always collect sensitive data, when we do, the purpose of collecting sensitive information is to understand you better to make more relevant recommendations to you and/or to provide a better service.

HOW LONG TSC FINANCIAL SERVICES LIMITED KEEPS YOUR DATA:

Our maximum retention period is five years after the end of our relationship with you, to comply with applicable legal requirements.

If you decide not to purchase a financial product and/or service through us, with your consent, we will retain your information for a period of up to three years to enable us to service your needs if you were to change your mind.

PROCESSING DATA INTERNATIONALLY:

Your personal information will be provided to the relevant Product and/or Service Provider.

These may include certain entities located outside the Cayman Islands or the European Economic Area. The Product Providers will process your personal information for their own lawful purposes in connection with the financial product provided to you.

We use selected third-party service providers based outside of the Cayman Islands and will transfer your personal information to establish, service, and maintain your financial product and client relationship. These may include certain entities located outside the Cayman Islands or the European Economic Area.

Where we make a transfer of your personal information outside of the Cayman Islands, we will take the required steps to ensure that your personal information is protected. This will include placing the party we are transferring information to under contractual obligations to protect it to adequate standards.

KEEPING YOUR INFORMATION SAFE:

TSC Financial Services Limited prioritises the security and privacy of your Personal and Sensitive Personal Information.  

We have strict security standards, and all our staff gets regular training annually about how to keep information safe, including their responsibilities around information security, fraud prevention, and privacy obligations.

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used, or accessed in an unauthorised way, altered, or disclosed. Also, we limit access to your personal information to those employees, agents, and other third parties who have a business need to know. They will only process your personal information on our instructions, and they are subject to a duty of confidentiality.

We have several organisational and technical security measures in place to prevent fraud and cybercrime.  

We will restrict internal access to your information to only those that need to know to perform the purposes laid out above.

Tools such as firewalls, anti-virus software, and malware protection are used across the business. Our internal procedures cover the storage, access, and disclosure of your information.

We shall notify you of any personal data breach that is reasonably likely to result in a risk to your interests, fundamental rights, or freedoms.

TSC Financial Services Limited is the data controller.

Where TSC Financial Services Limited uses contractors to deliver services, they are acting as TSC Financial Services Limited’s data processor, and TSC Financial Services Limited and our data processors share responsibility for how your data is handled.

TSC Financial Services Limited also works closely with other data controllers, especially where functions are linked or complement each other.

YOUR RIGHTS WHEN TSC FINANCIAL SERVICES LIMITED USES YOUR INFORMATION:

Right to Request A Copy of Data Held on You

You have the right to request and receive a copy of the data that we hold about you. TSC Financial Services Limited does not charge for this.  TSC Financial Services Limited will process your request within 21 days of receipt of a formal request in writing.

Right to Correction

You have the right to have inaccurate personal data corrected. Let us know if your circumstances change and we will ensure your data is updated. This can be information such as your address, when you start work, or when you leave a place of employment.

Right to be Forgotten

This is the right to have personal data erased, also known as the ‘right to be forgotten’.  You do not have the right to request that your data is erased.  Your data will be retained by TSC Financial Services Limited because it is required by law, or because it is the function of TSC Financial Services Limited to do so, or because it is in the public interest.

Right to restrict processing

You can request that we restrict the processing of data, however, we can refuse to comply if your request is unfounded or excessive, or repetitive in nature but we will justify the decision to you and will inform you of any decision that has been made.
